| 연구목적 | ○ With the development of commodity economy especially in the globalization of products’ manufacture and sales, the issue on product liability has become widespread and more complicated. Most countries have become to concentrate on the legislation of consumer protection in order to protect the interests of consumers. ○ Nowadays there are three kinds of legislation of product liability overseas: 1) enlarge the explanation and apply the regulation from contract law and law of tort (ex. France, Holland); 2) establish some product liability regulation referenced in other related laws such as ‘Law on the Protection of Consumer’ (ex. Britain, Canada); 3) legislate a single law of product liability (ex. America, Japan, Germany, Italy, Denmark) ○ In just a few decades, China has transitioned from having no consumer economy to being the largest consumer market in the world. China is unique-it is a developing country with a developing legal system, but has a booming economy and a vast number of consumers. It is therefore neither a typical emerging market country nor an equivalent of a Western industrialized country. These attributes pose many challenges for the effective implementation of a legal regime for consumer protection. |
