현대 위험사회에서 선박운항자의 형사책임에 대한 비판적 고찰과 입법적 제언

Abstract

부존자원이 빈약한 우리나라의 경우 해외 수출입은 국민의 사활이 걸린 중대한 문제이며, 이러한 수출입 물동량의 대부분은 해상교통을 통하여 운송되고 있다. 그렇지만 해상교통의 중대한 사회적 유익성에도 불구하고 우리 선원은 해상근무조건의 열악함과 형사처벌의 두려움으로 점차 승선근무를 기피하는 경향이 있기 때문에 외국선원으로 대체되고 있다. 따라서 해운관련 기관과 학회에서는 선박운항자의 근무환경개선과 해운산업활성화를 위하는 한 방편으로 육상의 교통사고처리특례법을 모델로 하여 해상교통사고처리특례법의 제정을 주장하고 있다. 이 논문에서는 해상교통의 배경으로 작용하고 있는 위험사회에서 바람직한 형법의 역할을 우선 제시하고서, 이를 바탕으로 허용된 위험과 신뢰의 원칙을 통한 선박운항자의 책임제한 여부를 검토하고 있다. 이어서 교통사고처리특례법과 해상교통사고처리특례법의 제정 주장을 비판적 입장에서 분석한 뒤, 해상교통의 안전확보의 측면에서 선박운항의 위험지배에 따라 선박운항자 및 선박회사의 형사책임에 대하여 입법적 방향을 제시하고 있다.

In our country where has meager endowed resources, international import and export is a serious issue that affects the very existence of the nation and most of the import and export trade volume is transported via marine transportation. Despite the great social benefits of marine transportation, our crews are reluctant to works related with marine transportation for poor working conditions in the maritime and fear of criminal punishment, so it is being replaced by a foreign crews. Accordingly, shipping agencies and society claim to enact of Special act on marine traffic incident process on the model of Special act on land traffic incident process for ship operator’s improved working conditions and activation of the shipping industry. In the study, firstly, it suggests a role of a preferred criminal law in the risk society in the background of maritime traffic, and it reviews ship operator’s limitation on liability by the principles of allowed risk and trust. Next, after it is analyze claims to enact Special act on traffic incident process and Special act on traffic incident process in the critical positions, it presents a legislative direction to criminal liability of ship operators and the shipping company according to risk control of ship operation in terms of ensuring maritime traffic safety.
