한국의 시장경제의 모형과 경제민주화의 뜻

Abstract

이 글은 경제민주화 논쟁에 대한 규범적 접근을 통해 경제민주화 조항의 의미와 정책방향을 제시하는 것을 목적으로 한다. 시장경제는 대의민주정과 더불어 국민국가 한국의 기축적 질서를 구성한다. 시장경제의 헌법적 기초는 헌법 제119조라기 보다는 오히려 다양한 기본권조항들이며, 한국 헌법이 지향하는 시장경제를 독일형 사회적 시장경제로 파악하는 것은 비판의 소지가 크다. 우리 경제의 연혁과 구조, 시장참자가의 행태가 독일과 크게 다르기 때문이다. 시장경제의 규범적 모형설정에 있어서는 각종 경제관련 입법과 이에 대한 헌법재판소의 헌법적합성 심사가 매우 중요하며, 보충성, 비례평등, 과잉금지, 기본권이 본질적 가치훼손 금지 등의 심사기준이 적극적으로 구사되어야 한다. 헌법 제119조 제2항은 국가가 시장에 개입할 수 있는 다수의 사유를 열거하면서 경제민주화라는 문언을 사용하고 있다. 경제민주화는 개별적 규제사유가 아니라 여러 개입사유를 포섭하는 상위개념으로 파악하는 것이 바람직하다. 각계 각층이 토해내는 국민적 열망을 담아내는 해석학적 방편이 될 수도 있다. 경제주체간의 조화를 통한 경제민주화의 규범적 의미는 경제주체의 다양화와 이들 사이의 건강한 경쟁과 균형의 확보라고 생각된다. 보다 적극적인 정부의 시장개입, 대학이나 협동조합과 같은 비영리조직의 활성화도 필요하고, 과다한 규제를 털어내는 것 역시 여전한 과제다. 재벌규제정책을 진화시켜 경쟁력 있는 중소기업을 육성하고, 대중소기업의 협력관계를 개량하는 것이 경제민주화의 가장 긴박한 과제가 될 수 있다. 소상공인의 고충과 애환을 덜어주는 법제의 지속적 보완과 더불어, 동반성장 등 대기업의 자발적 협력에 기반을 둔 다양한 연성규범의 개발도 중요하다. 주제어:시장경제의 규범적 모형, 사회적 시장경제질서, 경제민주화, 경제입법의 헌법적합성 심사, 재벌규제

This essay is basically a normative approach to the recent 'Debate of Economic Democracy' which features one of the battle fields of the on-going presidential election of the Republic. Through the analysis, it is designed to illustrate the normative meaning of the so called 'democratization of national economy' and also give guidance to various industrial legislations. Along with liberal democracy, market economy moulds pivotal structure of the Republic as a modern nation state. Various clauses of basic human rights of the Constitution provide the basis for market economy, and normative model of national economy should be interpreted from the industrial legislations of National Congress and Constitutional Court's decisions over which constitutional values of subsidiarity, equal treatment, pro-rata, due process etc. should be prevalent. Par. II of Article 119 of Constitutional Code provides various causes of government intervention into the economy, and the wording of 'economic democracy' is recommended to win every causes of market interventions. And by doing so, desires and hopes of the public would enjoy the chances of constitutional interpretation. Diversification of economic players and healthy competition among them are supposed to be the core of normative meaning of economic democracy. Concerning policies against big business conglomerates of the republic, it is recommended that there would be development into positive policies from passive restrictions and burdening of the past.
