산림탄소상쇄제도에 관한 법적 고찰

Abstract

기후변화에 대비하여 저탄소 사회를 구축하기 위한 대표적인 방안은 산림을 이용하여 탄소를 흡수하는 방법이다. 산림은 이산화탄소 흡수원으로서 서로를 상쇄(相殺)를 하기 때문에 탄소 감축의 기능을 인정받고 있다. 최근 「저탄소 녹색성장 기본법」 에 따라 「탄소흡수원 유지 및 증진에 관한 법률」이 제정되었다. 「탄소흡수원 유지 및 증진에 관한 법률」은 2012년 2월 22일에 제정되었으며, 2013년 2월 23일에 시행이 된다. 동법의 제정은 저탄소 사회의 구현과 정부의 온실가스 감축목표를 달성하는 것을 목적으로 하고 있다. 특히 「탄소흡수원 유지 및 증진에 관한 법률」의 핵심은 산림탄소상쇄제도의 이행이다. 산림탄소상쇄 사업은 기업과 국민의 자발적인 탄소상쇄 활동과 탄소시장의 연계 시스템의 구축이다. 「탄소흡수원 유지 및 증진에 관한 법률」이 시행되기 전에도 산림을 통한 온실가스 감축사업이 시행되고 있었지만 탄소 포인트와 탄소 캐쉬백 등 국민이 편리하게 실생활에서 활용할 수 있는 프로그램과 사업이 연계되지 않았다. 그래서 본 연구에서는 탄소흡수원법을 기반으로 한 감축실적형과 사회공헌형 산림탄소상쇄제도의 이행 방안을 제시하고자 한다. 감축실적형 산림탄소상쇄제도는 기업의 자발적인 참여를 기반으로 하는 것이며, 크레딧 발행과 관리는 법적인 구속력을 가지도록 유도하는 것을 특징으로 한다. 특히 실질적인 탄소상쇄를 목적으로 사업을 운영하는 것이며 주요 대상사업은 나무심기, 산림경영, 바이오매스와 목제품 이용, 산림보전이 내용이다. 사회공헌형 산림탄소상쇄제도는 산림탄소상쇄센터를 중심으로 제도와 운영관리지침을 제공하는 행정기관, 실행자, 검증기관에 의해 운용하는 것이다. 국립산림과학원은 산림청과 함께 인증 표준을 제공하는 역할을 담당하며 크레딧 발급과 시장 거래를 통한 탄소상쇄 사업으로 발전하기 위한 교육을 실시한다. 주요 대상사업은 기업과 시민 참여에 의해 이루어지는 나무심기, 산림경영, 산림보전 등이다.

Reduction performance forest carbon offset scheme, which is based on the participation of companies, and credit issuance and management guided to a legally binding. Substantial carbon offsetting business purposes, operating a business, and the main target is developed on the premise that the forest carbon offset standard tree planting, forest management, biomass and wood utilization, forest conservation content. Social contribution type forest carbon offset scheme can be operated by the executor Center system and operations management, provide guidance to government agencies, forest carbon offset verification agency.
