일본에서의 간접적 관여자에 대한 저작권침해주체성의 판단에 관한 연구

Abstract

일본에서는 간접적 관여자에 대한 저작권침해주체성의 판단에 관하여 다양한 판례들과 법리들이 나타나고 있는데, 특히 “클럽캣츠아이 사건” 이후에 가라오케 법리가 정립되고 그 이후에 이것에 대한 확장해석 및 비판과 새로운 견해 등이 등장하면서 본 주제에 대한 논의가 활발해지고 있으며, 최근에는 기존의 가라오케 법리에만 구속되지 않고 다양한 요소들을 복합적으로 고려하여 구체적인 사례에 맞는 판단을 하는 경향이 강해지고 있다. 이러한 경향속에서 간접적 관여자의 침해주체성 판단과 관련하여 새로운 규정을 저작권법상에 만들어서 해결하자는 입법론과 기존의 법규정을 가지고 해결이 충분하다는 견해가 대립되고 있기도 하다. 한편, 우리나라에서는 관련 판례들이 풍부한 일본에서의 경우와는 달리 실제 판례상으로도 저작권침해행위의 간접적 관여자 등에 관한 귀책법리의 판단사례 등이 극히 미약한 상황이다. 따라서, 간접적 관여자에 대한 저작권침해주체성 판단에 관한 다양한 사례들이 나타나고 있는 일본 저작권법상 판례들의 경향과 관련 이론들을 구체적으로 검토하여 우리나라에서의 향후의 판단방법과 입법론 등에 관하여 중요하게 검토하여 볼 필요가 있다고 생각된다. 이와 관련하여 본 논문은 간접적 관여자에 대한 저작권침해주체성의 판단과 관련된 다양한 일본의 판례들과 이론들을 구체적으로 검토하고 있으며, 구체적으로는 간접적 관여자와 침해주체성판단과의 관계, 간접적 관여자의 침해주체성 판단의 경향 등에 대해서 일본 저작권법상 판단사례들을 근거로 하여 세부적으로 고찰하였다.

In Japanese Copyright Law, various court cases and principles of law for determination of a main body infringing copyright for a indirect partaker have appeared. Particularly, “Karaoke principle of law” has been set up after “Club Cats Eyes” case appeared in Japanese court. Following that principle, extention of interpretation, criticism and new opinions for that Karaoke principle of law appeared. According to that various opinions, arguments for the main subject of this paper became to be active. Particularly, there have been conflicts between legislation theory in which this related problems can solved by making new regulations about indirect infringement and opinions in which this related problems can be solved sufficiently by the established regulations of copyright law. This paper studied on the above contents by reviewing Japanese court cases and the related theories concretely and simultaneously with that, I reviewed in detail relations between indirect partaker and determination of a main body infringing copyright, trends for determination of a main body infringing copyright and various types of indirect participations for infringement of copyright and applications of copyright law to that related cases in this paper.
